PRIVACY POLICY - ENGLISH

When entering into agreements with us, or when interacting with us in any other way, we, Zealand Coating ApS (”Zealand Coating”, ”us”, ”we”, ”our”), collect and process personal data about you, including data about you as a contact person of the company by which you are employed. Thus, we are the data controller, and we have the following contact information:

Below, we will inform you of how we collect and process your personal data when you, for instance as a contact person of the company by which you are employed enter into agreements with us; and /or when you contact us, including when you apply for a position with us. Our collection and processing will take place in accordance with current legislation in force at any time, including the General Data Protection Regulation (the GDPR).

When entering into an agreement with us – either in the capacity as a customer, supplier or business partner

When entering into an agreement with us, we collect information about name of the company, address, company registration number together with your contact details as the contact person of the company, including name, title, email and phone number.

The purpose of the processing is for us to be able to fulfill our part of the agreement entered into with your company, including – for instance – in order to place orders, confirm and deliver purchases, arrange for payments, provide service to you in connection with complaints, credits, etc.

The legal basis of the processing is that the processing is necessary for the performance of a contract to which we are a party (GDPR art. 6(1)(b)).

Moreover, we process data about the agreement in order to comply with a legal obligation to which we are subject (GDPR art. 6(1)(c)), i.e. requirements in terms of accountancy and bookkeeping.

If you are a customer, we also process data about your purchases for the purposes of marketing new products, sending you special offers, etc. The legal basis of the processing is our legitimate interest in marketing ourselves (GDPR art. 6(1)(f)) and your consent (GDPR art. 6(1)(a)) in case this is required by law.

We will, generally, retain the data about our business relations for 5 years following the end of the year in which the business took place. After this period, we will delete the data.

When you contact us

When you contact us, we will process data such as name of the company, address, company registration number, your contact details as contact person of the company, including your name, title, email and phone number.

The purposes are to respond to your inquiry and to provide you with the best possible service. The legal basis of the processing is found in this legitimate interest (GDPR art. 6(1)(f).

Generally, we will retain the data for 5 years after our response to your inquiry whereupon we will delete the information.

When you contact us in connection with a job application

When you contact us with a view to applying for a position, we will typically process your name, email address, phone number, information from your cover letter, curriculum vitae, relevant documentation such as grade transcripts and/or diplomas and letters of recommendations along with any other information you may provide.

When forwarding your application, we kindly ask you to cross out your civil registration number (CPR number), for example on grade transcripts and/or diplomas, as we do not need this information. Further, we request you not to include any sensitive personal data (i.e. information revealing racial or ethnic origin, religious beliefs, trade union memberships, data concerning sex life, health, etc.) in the application.

We process the above data about you with a view to assessing your application, including your qualifications, and with a view to determining whether we will offer you employment with us.

The legal basis for this processing is our assessment of you in regard to a specific position prior to entering into a potential employment agreement (GDPR art. 6(1)(b)) together with our legitimate interest in processing and retaining your personal information with a view to a potential employment (GDPR art. 6(1)(f)). If we conduct reference checks, the legal basis will be your consent (GDPR art. 6(1)(a)).

We will, generally, retain your personal data for 6 months subsequent to a potential rejection of your application whereupon we will delete them unless you have consented to a longer retention period.

Recipients of your personal data and disclosure to third parties

We will process your data confidentially, and besides disclosure of your data to a carrier for the purposes of delivering your purchases, we will not disclose your data to any third parties unless required by law or in case it is necessary in order to pursue the above purposes.

Data processors and transfer of personal data to countries outside the EU/EEA

When processing your personal data, we may make use af data processors who process data on our behalf and upon instructions from us. Such data processors are subject to confidentiality and obligations to implement appropriate technical and organizational measures that live up to the legislation.

We enter into written data processing agreements with all data processors who process data on our behalf.

Generally, we do not transfer your personal data to countries outside the EU/EEA.

In case transfers to countries outside the EU/EEA may be necessary in order to pursue one or more of the above purposes, such transfers will take place in accordance with any relevant data protection legislation and will be subject to appropriate safeguards, such as for instance the European Commission’s standard contractual clauses.

Your rights

When processing your personal data, you have the right to

  • request for access to, rectification of or deletion of your personal data
  • have the processing of your personal data restricted
  • object to the processing (for example, as regards the processing of personal data for direct marketing purposes)
  • withdraw any given consent to the processing of your personal data by writing to info@zealand-coating.com (the withdrawal of your consent will not affect the lawfulness of the processing based on consent prior to your withdrawal)
  • a right to receive the personal data concerning you which you have provided us, in a structured, commonly used and machine-readable format (data portability)
  • file a complaint about our processing of your personal data with the Danish data Protection Agency (read more about filing complaints here: Datatilsynet)

 

The above rights may be subject to limitations or conditions which means that – as an example – you may not have the right to have your personal data deleted in all cases.
